Let me ask you a question first!
What could have been the origin of the legal system? Perhaps the tyranny by the Autocrats, Monopolising resources by a few, oppression by powerful people, etc. With the onset of civil liberties , democracy and a common law for everyone also came the darker side of the law, its bureaucracy, smart lawyers, exploiting the loopholes, etc.
Alas, with the over- commercialisation, the legal practice somehow lost the plot and the purpose for which it was created, i.e. helping the vulnerable got lost somewhere. |

Expensive Lawyers, charging by the minute, Suing culture, Probates, Copyright, etc. and the list goes on and the bill of the lawyers & pressure on judiciary, Pendency, keeps mounting. Things which may seem so simple and logical have been turned into complex discussions of one argument v/s another. Whoever is mightier may win at the cost of the other, however they can’t live cordially after such a verdict is made.
So, what are the options now:
- Can the litigation culture be changed? Seems difficult, though there are increasingly more supporters of Mediation and Conciliation.
Yes there is hope that people could see sense by sitting down and having a dialogue to resolve their conflicts. |
